General Terms and Conditions (GTC)

The Provider is hereinafter: “Provider”.
The party placing the order is hereinafter: “Customer”.

2. General provisions
2.1. These General Terms and Conditions define the contractual rights and obligations between the Provider and the Customer when using the services provided by the Provider.
2.2. The Provider’s main activity is digitization, archiving of films, videos, images and audio materials, and related supplementary services.
2.3. By using the service the Customer acknowledges that they have read and accepted the provisions of these General Terms and Conditions.

3. Order and formation of the contract
3.1. Orders may be placed in person, by email, by phone or by completing the contact form on the website.
3.2. The Provider confirms the order in writing (by email) or verbally (by phone).
3.3. The contract is formed when the Customer accepts the confirmation.
3.4. The Provider is entitled to request a deposit before work begins.

4. Service performance
4.1. The performance deadline is determined depending on the nature and quantity of the service ordered.
4.2. The Provider delivers digitized materials to the Customer in the format and on the data carrier agreed in advance.
4.3. If performance is obstructed, the Provider must inform the Customer without delay.

5. Fees and payment terms
5.1. The service fee is determined on the basis of an individual quote and includes VAT.
5.2. Payment methods: cash, bank transfer, or other method agreed in advance.
5.3. The Provider issues the invoice upon completion.
5.4. In case of late payment the Provider is entitled to charge late interest in accordance with the Civil Code.

6. Right of withdrawal for consumers
6.1. Under Government Decree 45/2014 (II. 26.) the consumer is entitled to a 14-day right of withdrawal without giving reasons.
6.2. The right of withdrawal cannot be exercised for a service that the Provider performed with the Consumer’s express prior consent and where performance began before the expiry of the 14-day period.
6.3. Intention to withdraw must be communicated in writing using the Provider’s contact details.

7. Liability
7.1. The Provider takes all reasonable measures for the safe handling of materials handed over by the Customer.
7.2. The Provider is not liable for deficiencies arising from the quality, damage or technical faults of the source material.
7.3. It is the Customer’s responsibility that materials handed over for digitization contain lawful content.

8. Data processing
8.1. The Provider processes personal data in accordance with Privacy Policy as set out in the Privacy Policy, available on the website.
8.2. The Provider’s data processing complies with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

9. Complaint handling
9.1. The Customer may submit a complaint in writing or by phone using the Provider’s contact details.
9.2. The Provider investigates the complaint within 30 days and responds in writing.
9.3. In a consumer dispute the Customer may turn to a conciliation body.

10. Dispute resolution
10.1. The parties shall settle disputed issues amicably.
10.2. If that fails, Hungarian law applies; disputes shall be adjudicated by the court with jurisdiction at the Provider’s registered office.

11. Final provisions
11.1. The Provider is entitled to amend these General Terms and Conditions unilaterally; amendments take effect on the date of publication on the website.
11.2. By using the service the Customer accepts the amended terms.
